This lawsuit seeks to recover unpaid overtime premium pay for employees who worked for Abbey Road Control, Inc. as Flaggers. The lawsuit alleges that Abbey Road failed to record and pay hourly Flagger employees for certain time (including travel time) arising at the beginning and end of the claimed workday that should have been included in calculating Flaggers' work hours for overtime pay. Abbey Road denies violating any laws, and the Judge has not decided who will win.

OCT 12, 2020
Today we filed a class and collective action Complaint against Abbey Road Control, Inc. on behalf of hourly Flagger employees under federal and Pennsylvania law. A copy of the Complaint is available below. It is expected that the company will deny that it violated the law.
FEB 12, 2021
Today lawyers for Abbey Road Control, Inc. filed an Answer in which it generally denied the allegations in the Complaint. The Court will be holding an initial scheduling conference shortly.
MAR 3, 2021
Today we participated in an initial scheduling conference with the Court. At the conclusion of the conference, the Court issued an initial scheduling order setting deadlines to move for class and collective certification in late April. A copy of the Court's order is below.
JUL 2, 2021
Today the Court entered an order approving the parties' stipulation to conditional certification of the FLSA collective in this case. A court-approved notice will be sent to eligible Flagger employees of Abbey Road in the coming weeks giving them the opportunity to join this case. A copy of the Court's order is below.
OCT 8, 2021
The notice period has ended and we are excited that 56 hourly Flagger employees are now covered by the case.
DEC 2, 2021
Today the Court issued an updated scheduling order setting deadlines for the discovery phase of the case which will last several months. A copy of the order is available below.
AUG 24, 2022
Today the parties had a telephone conference with the federal judge assigned to this case. At the conclusion of the conference, the judge issued a scheduling order setting forth the remaining deadlines including trial in this case. A copy of this order is available below.
