This lawsuit seeks to recover unpaid overtime wages for home health workers who worked for Americare Home Solutions LLC. The workers allege that Americare violated federal and Pennsylvania wage law by failing to pay them proper overtime premium compensation for all hours worked over 40 per week. Specifically, the lawsuit alleges that the company had a policy of reducing the employees' hourly pay rates during weeks in which they worked over 40 hours. The company denies that it violated any laws and the Judge has not decided who will win.

Today, we are pleased to announce that Judge A. Richard Caputo of the Middle District of Pennsylvania issued an order conditionally certifying this case as a collective action. In accordance with the Court’s ruling, notice will be mailed out in the coming weeks to every individual who: (i) was employed by Americare between September 1, 2017 and April 13, 2018; (ii) was paid on an hourly basis; and (iii) had his/her hourly pay rate lowered during at least one week in which he/she was paid overtime premium compensation.
