This class action lawsuit seeks to recover unpaid overtime compensation for Mortgage Loan Officers who worked for National Penn Bank before it was acquired by BB&T bank. The lawsuit alleges that the bank violated Pennsylvania overtime law by failing to pay them overtime premium compensation for hours worked over 40 per week week. The bank denied all liability. As indicated below, this lawsuit has been resolved.

MAY 2, 2016

Today, our firm started a class action lawsuit by filing a Complaint against BB&T Corporation in the Philadelphia Court of Common Pleas. The lawsuit alleges that National Penn Bank, prior to being purchased by BB&T, violated the Pennsylvania Minimum Wage Act by failing to pay its Mortgage Loan Officers (MLOs) extra overtime compensation for hours worked over 40 per week. Instead, the MLOs were only paid a commission based on the number of mortgage loan and refinance products that were purchased by National Penn customers. The Complaint asks that the Court certify a class of all individuals who, during any time since May 2, 2013, worked for National Penn Bank as MLOs in Pennsylvania. JUL 13, 2016

Today, the bank filed an Answer denying violating any laws and asserting that its pay practices are legal. The Answer is available below.

SEP 8, 2017

We are pleased that this lawsuit has been resolved. Earlier today, the Judge entered an order terminating the case.
