This lawsuit seeks to recover unpaid overtime compensation for homecare workers who worked for CareGivers America, LLC. The homecare workers allege that CareGivers violated Pennsylvania law by failing to pay compensation for time spent travelling between clients.

Today, our firm, along with co-counsel Barrett Johnston Martin & Garrison LLC, started this class action lawsuit by filing a Complaint in the Philadelphia Court of Common Pleas against Caregivers America, LLC. The lawsuit is brought on behalf of individuals who worked as home health workers for Caregivers America in Pennsylvania and alleges that the company violated the Pennsylvania Minimum Wage Act when it failed to pay these individuals for all hours worked. Specifically, the Complaint alleges that Caregivers America only paid its home health workers for just their scheduled hours and not other compensable time such as travel between clients. MAY 16, 2017
Today we filed an Amended Complaint against Caregivers America, which can be accessed below. As part of this Amended Complaint, claims under the Fair Labor Standards Act and the Pennsylvania doctrine of unjust enrichment were added. In addition, the proposed class was redefined to include “all individuals who have worked for Defendant as hourly caregivers and, on at least ten (10) individual workdays during the period from November 10, 2012 until February 17, 2017, traveled between the homes of two or more different clients.”
