This lawsuit seeks to recover unpaid wages for restaurant servers who worked at the Houlihan’s restaurant in Hershey, Pennsylvania operated by Hershey Entertainment & Resorts Company. The servers allege that the Company violated federal and state wage laws by paying them a tipped minimum wage less than $7.25 per hour and requiring that they perform significant side-work tasks such as, for example, rolling silverware; setting up drink stations, cleaning the soda machine, filing sauce containers, setting-up the salad cooler, preparing food, slicing fruit, sorting silverware and ramekins, and cleaning the Restaurant. It is anticipated that the Company will deny that it violated any laws.

SEP 27, 2019

Today, our firm filed a collective and class action lawsuit against Hershey Entertainment & Resorts Company in the Middle District of Pennsylvania. The lawsuit alleges that the Company violated the Fair Labor Standards Act and Pennsylvania wage law by paying servers at its Houlihan’s restaurant in Hershey, Pennsylvania below $7.25 an hour but required that they spend a significant portion of their work time performing non-tip producing work. Examples of the non-tip producing work includes, for example, rolling silverware; setting up drink stations, cleaning the soda machine, filing sauce containers, setting-up the salad cooler, preparing food, slicing fruit, sorting silverware and ramekins, and cleaning the restaurant. The lawsuit seeks to proceed on behalf of all Servers employed at the Hershey restaurant during any workweek within the last three years.

DEC 2, 2019

Today the Defendant filed a motion to dismiss the case. A copy of this motion is below. We will be filing an opposition in the coming weeks and hope to have a decision by the Court in early 2020.


JAN 8, 2020

Today we filed an opposition to Defendant's motion to dismiss the case. A copy is available below. We anticipate that it will take several weeks for the Court to rule on this motion.


FEB 25, 2020

Today the federal judge assigned to this case denied the company's motion to dismiss. A copy of the opinion is available below. We will now proceed to the discovery phase of the litigation.


MAY 28, 2020

Today, the federal Judge overseeing the lawsuit issued an order conditionally certifying a collective in this case under the Fair Labor Standards Act. Notice of this lawsuit will now be sent to potentially covered servers at the Restaurant in the coming weeks. The deadline to join the case under the FLSA will be July 20, 2020.


DEC 30, 2020

Today, the Court issued an Order approving the settlement of this action. A copy of the Order is available below.
