Today, our firm filed a class and collective action lawsuit against InfoCision Management Corporation in the United States District Court for the Western District of Pennsylvania on behalf of Phone Operators. The lawsuit alleges that InfoCision violated federal and Pennsylvania law by failing to pay Phone Operators for time spent performing pre-shift activities such as, for example, booting-up their assigned computers and accessing different computer programs in order to make and receive calls. Today, we are pleased to announce that Judge David S. Cercone of the Western District of Pennsylvania conditionally certified a collective under the FLSA pursuant to 29 U.S.C. § 216(b). In accordance with the Court’s ruling, notice will be mailed out in the coming weeks to “all individuals who, in the three (3) years preceding the filing of this Stipulation, were employed by Defendant in the United States and actively worked more than forty (40) hours as a Communicator during any workweek.” You can access a copy of the Court’s order below.
