This class/collective lawsuit has been filed in the federal court in Philadelphia, PA on behalf of current and former Adult Protective Service Caseworkers (a.k.a. Investigators) who worked in Pennsylvania for Liberty Healthcare Corporation. These hard-working Caseworkers/Investigators investigate allegations of abuse against adults with disabilities. They work long hours and carry heavy caseloads.
Some of the Caseworkers/Investigators are paid directly by Liberty, while others are paid by a staffing agency called Sargent's Personnel Agency. Regardless of who cuts the paycheck, all of the Caseworkers/Investigators fall under Liberty Healthcare's control.
The Caseworkers/Investigators never receive overtime pay for working over 40 hours per week because they are classified by Liberty as "exempt" from federal and state overtime laws. The lawsuit alleges that this overtime-exempt classification is incorrect under federal and state law. A copy of the federal court complaint is available below.
The lawsuit is in its early stages. Liberty and Sargent's have filed answers asserting that they did not violate any overtime laws. The Judge has not decided who will win.
As indicated below, 41 current and former Caseworkers/Investigators have joined this lawsuit. We are very pleased to represent these hard-working employees.

Today, the Federal Judge entered an order "conditionally certifying" this lawsuit as a "collective action." A copy of the order is available below. As a result of this order, all individuals who worked as Liberty Caseworkers/Investigators during any time since June 22, 2017 have been mailed a package containing a Notice Form describing the lawsuit and a Consent Form that can be completed and returned in order to join the lawsuit. These packages were mailed on December 28, 2020 to each individual's last known address. In order to participate in the lawsuit, covered individuals must return the Consent Form by February 1, 2021. If you believe you are covered by this lawsuit but have not received your forms in the mail, please call the office (215-866-1551) so that we can confirm your eligibility and make sure you receive your forms.
