In this class action lawsuit, we represent a former employee at the Manor at Susquehanna Village, a nursing home located in Millersburg, PA. The lawsuit is going forward in the United States District Court in Scranton, PA. The lawsuit alleges that, in September 2017, the nursing home improperly eliminated many hours of unused leave time accumulated by our client and other nursing home employees. In the lawsuit, Ms. Knapp claims that she and similar employees are entitled to monetary compensation for all eliminated leave hours under the following legal theories: breach of contract; Pennsylvania Wage Payment and Collection Law (“WPCL”), 43 P.S. §§ 260.1, et seq.; promissory estoppel; and unjust enrichment.
The Judge has issued an order permitting the lawsuit to go forward on behalf of a 61-member "class" of nursing home employees. The nursing home denies liability and has filed a motion to dismiss the lawsuit. The Court has not yet decided who will win the lawsuit.

Today, the Judge entered an order changing the name of the defendant to Susquehanna Village Facility Operations, LLC, which is the name of the company that owned the nursing home during the relevant time period. A copy of this order is available below.
APR 22, 2019
Today, the Judge entered an order certifying this lawsuit as a class action. The certified class includes 61 individuals and and is defined to include: "All persons who at the time Defendant stopped operating The Manor at Susquehanna Village: (i) were currently employed by Defendant at the Manor; (ii) had been employed by Defendant at the Manor for at least one year; and (iii) had positive leave time balances." Today, the judge assigned to this case issued an order granting preliminary approval of the class action settlement. A final approval hearing has been scheduled for June 18, 2020. A copy of this order is available below.
