This collective and class action lawsuit is going forward in the federal court located in Allentown, PA. The lawsuit seeks to recover unpaid overtime wages for all individuals employed by NewRez LLC within the past three years who have been paid an hourly wage plus additional "OTI Elig Bonus" compensation. The lawsuit alleges that NewRez failed to factor in payments classified in the Company’s payroll system as “OTI Elig Bonus” in calculating the rate at which overtime compensation was calculated for weeks in which employees worked over 40 hours. These “OTI Elig Bonus” payments were made to certain employees when, for example, they worked processing loans and received bonuses outside of the Company’s compensation system during the weekend. NewRez LLC denies that it violated any laws.

MAY 5, 2022
Today, NewRez LLC filed its Answer to the Complaint. A copy of the Answer is available below. As indicated, the company alleges that its calculation of overtime wages was legally correct and that it has not violated federal or state law.
AUG 10, 2022
Today, the Federal Judge entered a stipulated Order "conditionally certifying" this lawsuit as a "collective action." As a result of this Order, current and former employees who were paid an hourly wage plus "OTI Elig Bonus" compensation will be mailed a "Notice Form" describing the lawsuit and a "Consent Form" that can be used to join the lawsuit. A copy of this Order is available below.
NOV 10, 2022
We are very pleased to report that, as of today, 139 current and former employees have joined this lawsuit by returning "Consent Forms." The deadline for individuals to join the lawsuit is November 10, 2022.
