This lawsuit seeks to recover unpaid overtime compensation for salaried managers who worked for Portables Unlimited Retail, LLC at T-Mobile store locations. The managers allege that Portables Unlimited violated federal and Massachusetts wage law by paying them a salary and classifying them as exempt from overtime pay.
According to the lawsuit, the store managers are entitled to overtime pay because, among other reasons, they spend most of their time performing the same type of non-managerial work as the stores' hourly employees. The company denies violating any laws.

Today, our firm started this class and collective action lawsuit by filing a Complaint in the Federal Court for the Southern District of New York. The lawsuit is brought on behalf of employees who worked as salaried retail managers at T-Mobile stores operated by Defendant Portables Unlimited Retail, LLC (“Defendant”). The lawsuit alleges that by paying retail store managers a salary and classifying them as exempt from overtime premium pay for hours worked over 40 in a week, Defendant violated the federal Fair Labor Standards Act (“FLSA”) and Massachusetts state law.
