DEC 27, 2016

Today we filed a class and collective action Complaint in the Eastern District of Pennsylvania against CookNSolo, Inc. on behalf of servers at its Zahav restaurant located in Philadelphia, Pennsylvania. The lawsuit alleges that Zahav violated the Fair Labor Standards Act, the Pennsylvania Minimum Wage Act and the Philadelphia Gratuity Protection Bill by paying its servers a sub-minimum wage of $2.83 per hour plus tips but requiring that servers pay a portion of their tips to silverware polishers. The lawsuit alleges that the silverware polishers do not have sufficient and direct customer interaction to allow them to participate in the tip pool. The lawsuit seeks to proceed as a collective action under federal law and a class action under Pennsylvania and Philadelphia law on behalf of all individuals who, during any time within the past three years, have been employed as servers at the Zahav restaurant. JUL 6, 2017

We are happy to announce that today Magistrate Judge Timothy R. Rice granted our motion for preliminary approval of the class and collective action settlement of this case on behalf of servers at the Zahav restaurant located in Philadelphia. The Court ordered that notice of the settlement be sent to members of the class and scheduled a final approval hearing for October 24, 2017. You can access a copy of the Court’s order below.
