This class/collective lawsuit has been filed in the federal court in Philadelphia, PA on behalf of Case Managers employed by Asociacion Puertorriquenos en Marcha, Inc. (APM). Case Managers are dedicated employees, who work hard to provide services to children and families in Philadelphia's foster care system. Case Managers carry heavy caseloads and work long hours. Unfortunately, they do not receive any extra overtime pay for hours worked over 40 per week.

This lawsuit challenges APM's failure to pay overtime to Case Managers. In our opinion, the Case Manager position is the type of job that is "exempt" from the federal and state overtime laws.

The lawsuit is in its early stages. APM has filed an answer denying all liability. The Judge has not decided who will win.

The deadline to join this lawsuit has passed. We are very pleased that a total of 34 current/former Case Managers have joined the lawsuit. We look forward to representing these individuals in the months ahead.

NOV 19, 2018

Today, we filed the Complaint in the US District Court in Philadelphia. The complaint contains a very brief statement of of the basic facts and legal claims. A copy of the Complaint is available below.


FEB 14, 2019

Today, APM filed an Answer denying all liability. A copy of the Answer is available below.


MAR 5, 2019

Today, the Judge overseeing this lawsuit issued an order approving a set of forms that will be sent to all Case Managers employed by APM during any time after February 27, 2016. These forms provide basic information about the lawsuit and include a consent form that the recipient must complete and return if he/she wants to join the lawsuit. These forms are attached to the Judge's March 5, 2019 Order, a copy of which is available below. On March 22, 2019, the forms were mailed all individuals eligible to participate in the lawsuit. Importantly, anyone desiring to participate in the lawsuit must return the form by May 6, 2019.


MAY 17, 2019

The deadline for current/former Case Managers to join the lawsuit has now passed. We are very pleased that a total of 34 individuals have joined the lawsuit. We look forward to representing these individuals in the months ahead.


JUN 3, 2019

Today, the Judge overseeing this lawsuit issued an order scheduling the remainder of the lawsuit. A copy of this order is below.


JAN 2, 2020

The newly assigned Judge to this case has scheduled a conference for January 28, 2019 to set forth a new schedule for the remainder of the lawsuit. A copy of this order is available below.


JAN 29, 2020

Yesterday we participated in a scheduling conference with the Court. Today the Court issued a scheduling order for the remainder of the case which is available below.


JUL 20, 2020

Today, the Court issued an Opinion and Order approving the settlement of this action. A copy of the Opinion and Order is available below.
