The office managers allege that Heartland Dental violated federal overtime law by classifying them as exempt from overtime pay and failing to pay them overtime premium compensation for hours worked over 40 in a week.

JUN 16, 2016

Today, our firm, along with co-counsel Joseph, Greenwald & Laake, P.A., started this collective action lawsuit by filing a Complaint in the Federal Court in Greenbelt, MD. The lawsuit is brought on behalf of employees who worked as salaried Office Managers at dental offices operated by Defendant Heartland Dental, LLC. The lawsuit alleges that by classifying Office Managers as exempt from overtime premium pay, Defendant violated the federal Fair Labor Standards Act (“FLSA”) when they worked over 40 hours in a week. SEP 30, 2016

Today, the Defendant filed an Answer to the Complaint. In the Answer, Defendant denies violating the law and asserts that its pay practices are legal. You can access the Answer below.


NOV 10, 2016

Today, two former Office Managers represented by our firm accepted offers of judgments from Defendant Heartland Dental totaling more than $25,000.00 in unpaid wages and liquidated damages. Under the offers of judgment, Heartland Dental has asked the Court to enter judgment in favor of these two employees.


NOV 23, 2016

Today, a third former Office Manager represented by our firm accepted an offer of judgment from Defendant Heartland Dental totaling $2,500.00 in unpaid wages and liquidated damages.


MAR 10, 2017

Today we filed a Motion with the Court seeking approval of the three offers of judgment that were accepted in this lawsuit totaling over $28,000.00 in unpaid wages and liquidated damages for three former Office Managers. You can access a copy of this Motion below.


MAY 23, 2017

Today, Judge Peter J. Messitte of the United States District Court for the District of Maryland entered judgment against Heartland Dental and in favor of three Salaried Office Managers represented by Winebrake & Santillo and co-counsel. This judgment represented over $28,000 in unpaid wages and liquidated damages. Copies of the Court’s opinion and judgment are attached below.
