NorthEast Treatment Centers (a.k.a. NET Community Care)


This class/collective lawsuit has been filed in the federal court in Philadelphia, PA on behalf of Case Managers and Aftercare Workers employed by Northeast Treatment Centers, Inc. (a.k.a. NET Community Care). Case Managers and Aftercare Workers are dedicated employees who work hard to provide services to children and families in Philadelphia's foster care system. These employees carry heavy caseloads and work long hours. The case currently is going forward on behalf of over 45 individuals who have joined the lawsuit. The deadline for joining the lawsuit has passed.

Prior to around July 2019, Case Managers and Aftercare Workers never received overtime pay for working over 40 hours per week because NET classified them "exempt" from federal and state overtime laws. After July 2019, NET reclassified these employees as eligible for overtime.

The lawsuit challenges NET's business practices both before and after July 2019. For the time period before July 2019, the lawsuit alleges that NET's classification of Case Managers and Aftercare Workers as overtime-exempt was incorrect under federal and state law. For the time period after July 2019, the lawsuit alleges that NET failed to pay Case Managers and Aftercare Managers for all of the overtime hours they actually worked. NET has filed an answer asserting that it did not violate any overtime laws. The Judge has not decided who will win.

MAY 22, 2020

Today, we filed the Complaint in the United States District Court in Philadelphia. The complaint contains a brief statement of the factual allegations and legal claims. A copy of the complaint is available below.

AUG 21, 2020

Today, NET filed an answer denying any liability. A copy of NET's answer is available below.

SEP 11, 2020

Today, the Federal Judge entered an order setting a November 20, 2020 deadline for us to move for "certification" of this class/collective action. A copy of the order is available below.

NOV 5, 2020

Today, the Federal Judge entered an order "conditionally certifying" this lawsuit as a "collective action." A copy of the order is available below. As a result of this order, all individuals who worked as NET Case Managers or Aftercare Workers during any week after November 1, 2017 have been mailed a package containing a Notice Form describing the lawsuit and a Consent Form that can be completed and returned in order to join the lawsuit. These packages were mailed on November 27, 2020 to each individual's last known address. In order to participate in the lawsuit, covered individuals must return the Consent Form by January 11, 2021. JAN 11, 2021

As of today, a total of 46 workers have joined this lawsuit. The deadline for individuals to join this lawsuit has now passed.

MAR 15, 2021

Today, the Federal Judge entered a scheduling order establishing several deadlines that will apply to this lawsuit going forward. Under the order, all discovery must be completed by July 31, 2021. A copy of the scheduling order is available below.
