This class/collective lawsuit has been filed in the federal court in Philadelphia, PA on behalf of Case Managers and Outcome Specialists employed by Public Health Management Corporation (PHMC) and its affiliate, Turning Points for Children. Our firm is proud to represent these dedicated employees, who provide services to children and families in Philadelphia's foster care system. Case Managers and Outcome Specialists carry heavy caseloads and work long hours. Unfortunately, they do not receive any extra overtime pay for hours worked over 40 per week.

This lawsuit challenges PHMC's and Turning Points' failure to pay extra overtime compensation. We do not believe that the Case Manager or Outcome Specialist positions are the types of jobs that are "exempt" from the federal and state overtime laws. PHMC and Turning Points disagree and allege that these positions are not eligible for overtime pay. The Judge has not decided who will win.

The deadline for individuals to join this lawsuit has passed. We are very pleased that a total 101 current/former Case Managers and Outcome Specialists have joined the lawsuit.

Case Updates

OCT 17, 2017

Today, we started this lawsuit by filing a Complaint in the United States District Court in Philadelphia, PA. The case has been assigned to Judge Anita Brody. A copy of the Complaint is available below.

FEB 14, 2018

We attended an initial scheduling conference on February 10, 2017, and, earlier today, the Judge issued an order setting several deadlines that will apply to the case going forward.

MAR 30, 2018

Today, Turning Points filed an Answer denying that it violated the overtime laws. A copy of the Answer is available below.

JUL 27, 2018

The Federal District Court Judge has assigned this lawsuit to a Federal Magistrate Judge, who is assisting the parties in exploring a possible settlement. To date, no settlement has been reached. Settlement negotiations are confidential and cannot be publicized on this website. AUG 27, 2018

Our meetings with the Federal Magistrate Judge have not resulted in settlement, so we are pushing forward with this case. Today, the District Court Judge entered an order lifting the litigation stay and requiring the workers to file their "conditional certification" motion by September 20, 2018. A copy of the Order is available below.

OCT 1, 2018

Today, the Judge issued an order approving a set of forms that will be sent to all Case Managers and Outcome Specialists employed by PHMC or Turning Points during any time after January 12, 2016 (except for the 33 individuals who already have joined the lawsuit). These forms provide basic information about the lawsuit and include a form that the recipient must complete and return if he/she wants to join the lawsuit. These forms are attached to the Judge's October 1, 2018 Order, a copy of which is available below. On October 31, 2017, the forms were mailed all individuals eligible to participate in the lawsuit. Importantly, anyone desiring to participate in the lawsuit must return the form by December 15, 2018.

DEC 31, 2018

The deadline for individuals to join the lawsuit has passed. We are very pleased that a total of 101 current/former Case Managers and Outcome Specialists have joined the lawsuit. We look forward to representing all of these individuals going forward.

JAN 3, 2019

Today, the federal judge overseeing this lawsuit issued a schedule covering various deadlines for the next several months. A copy of this order appears below.

MAY 28, 2019

The lawsuit is in the "discovery" stage. During discovery, the parties' lawyers gather relevant evidence regarding the lawsuit. Under the Judge's schedule, the discovery phase will be completed by September 20, 2019.
