This collective action lawsuit is going forward in the federal court located in Philadelphia, PA. The lawsuit seeks to recover unpaid overtime wages for Traveling Merchandisers who performed rebuilds at Dollar General retail stores and were paid by Rhombus Services, LLC or BrandPoint Services (collectively, "the company"). The workers allege that the company violated federal law by failing to pay them full overtime premium compensation for hours worked over 40 per week. The company denies that it violated any laws.

Today, the Court entered a stipulated Order substituting "Rhombus Services, LLC (d/b/a BrandPoint Services)” for “BPS OPCO, Inc. (d/b/a BrandPoint Services)” as the proper named defendant. A copy of this Order is available below.

Today, Rhombus Services (d/b/a BrandPoint Services) filed its Answer to the Complaint. A copy of the Answer is available below. As indicated, the company alleges, among other things, that it does not "employ" merchandisers, but rather that these merchandisers are "independent contractors." In other words, the company alleges that its non-payment of overtime wages is legally correct and that it has not violated federal law.

Today, the Federal Judge entered a stipulated Order "conditionally certifying" this lawsuit as a "collective action." As a result of this Order, current and former traveling merchandisers who performed rebuilds for Dollar General will be mailed a "Notice Form" describing the lawsuit and a "Consent Form" that can be used to join the lawsuit.
