Winebrake & Santillo Obtains Conditional Certification in Overtime Rights Lawsuit on Behalf of Transit Bus Drivers for Krapf’s Coaches, Inc

Winebrake & Santillo, recently obtained conditional certification for a class of Transit Bus drivers for Krapf’s Coaches, Inc in Pennsylvania. The lawsuit is pending in the United States District Court for the Eastern District of Pennsylvania. The plaintiff alleges that he and other Transit Bus drivers were misclassified as exempt from federal and Pennsylvania overtime rights laws and thus were not paid overtime premium compensation for all hours worked over 40 in a single workweek. The federal court’s certification decision allows notice of the lawsuit to be sent to other Transit Bus drivers so that they will have the opportunity of joining the lawsuit.
